Terms
Terms & conditions
These terms and conditions apply to all quotes, assignments and agreements of Culinary Crew, established in Baarn, registered with the Dutch Chamber of Commerce under number 83714316.
1. Applicability
These terms apply to all offers, quotes and agreements between Culinary Crew and the client, unless expressly agreed otherwise in writing. Any general terms and conditions of the client are expressly rejected, unless Culinary Crew has accepted them in writing.
2. Quotes and formation of the agreement
All quotes are without obligation and valid for the term stated in the quote, or in the absence thereof for thirty days. An agreement is formed at the moment the client confirms the quote in writing or by email, or as soon as Culinary Crew begins the work. Changes after confirmation are only valid following written confirmation by both parties and may lead to an adjustment of the price.
3. Prices and payment
If you are a consumer (you are not acting on behalf of a business), all prices shown on this website include VAT. That is the price you pay. For business assignments, stated prices are exclusive of VAT unless otherwise indicated; this is also stated alongside those services on the website.
The price is based on the information provided at the time of the enquiry, including the number of guests. A definitive number of guests must be communicated no later than within the term stated in the quote; later changes may lead to a price adjustment. Invoices must be paid within fourteen days of the invoice date, unless otherwise agreed. In the event of late payment, the client is in default by operation of law and Culinary Crew may charge statutory interest and collection costs. Culinary Crew may require a deposit before the work begins. For reservations and bookings made via the website, a deposit of 40% of the total amount applies to secure the date; the remaining balance is due no later than five days before the event, or afterwards on final settlement. Payments are processed via our payment provider Mollie.
4. Cancellation
Cancellation by the client must be made in writing or by email. In the event of cancellation, depending on the moment of cancellation and the costs already incurred, cancellation fees may be charged. The closer the cancellation is to the agreed date, the greater the proportion of the agreed sum that may be due, partly to cover products already purchased and resources reserved. Where possible, the precise scale is included in the quote. For reservations booked via the website, the scale in article 9 applies.
5. Liability
Culinary Crew carries out its work to the best of its ability and with the care that may be expected of a skilled contractor.
What we never exclude. Liability for death or personal injury, and liability for damage caused by intent or deliberate recklessness, is not limited or excluded by us in any way. This expressly includes damage relating to allergens or food safety. Article 6 below describes the information we need from you, but does not affect this liability.
Other damage. For damage other than the above, our liability is limited to the amount paid out by our insurance in the relevant case, or, if no payment is made, to the invoice amount of the relevant assignment. We are not liable for indirect or consequential damage. This limitation does not apply insofar as it would be unreasonably onerous towards a consumer.
6. Allergens and food safety
The client is responsible for communicating all relevant allergies and dietary requirements of the guests in a timely and complete manner, no later than within the term stated in the quote. Culinary Crew takes these carefully into account in the composition and preparation of the menu. Culinary Crew works in accordance with the applicable guidelines for food safety and hygiene (HACCP). Culinary Crew cannot be held liable for reactions arising from allergies or dietary requirements that were not, or not in time, or incompletely communicated.
7. Force majeure
If Culinary Crew is wholly or partly prevented from performing the agreement due to force majeure, it is entitled to suspend performance or to dissolve the agreement, without being obliged to pay any compensation. Force majeure is understood to include, among other things: illness, staff absence, breakdowns, transport obstacles, problems with suppliers and all other external causes over which Culinary Crew reasonably has no control. In that case, Culinary Crew will make every effort to offer a suitable alternative.
8. Applicable law and disputes
Dutch law applies exclusively to all agreements and these terms. Disputes arising from or related to an agreement will be submitted to the competent court in the district where Culinary Crew is established, unless mandatory law provides otherwise. The parties will first make every effort to resolve a dispute by mutual consultation.
9. Additional provisions for consumers
If you book with us as a private individual, the provisions in this article apply. Where they differ from anything stated elsewhere in these terms, this article prevails. Provisions elsewhere that conflict with mandatory consumer law do not apply to you.
9.1 Cooling-off period when booking online
When buying at a distance, you as a consumer normally have fourteen days to withdraw. A statutory exception applies to our services: they concern leisure activities and catering for which we commit to a specific date. No right of withdrawal exists for such services, because we keep that date free for you and can no longer sell it to anyone else.
In practice this means: once you confirm your booking and pay the deposit, you cannot undo the agreement free of charge within fourteen days. You can, however, cancel under the scale in 9.2. You will also see this exception in the booking module before you pay.
9.2 Cancelling as a consumer
You can always cancel, by email or by phone. What you owe depends on how far away the date is, because the closer it gets, the more we have purchased and the more work we have had to turn down:
- More than 14 days before: you pay nothing. Any deposit already paid is refunded in full.
- 14 to 5 days before: you owe 25% of the total amount, to cover purchasing.
- 5 days to 48 hours before: you owe 75% of the total amount.
- Within 48 hours of the event, or if you do not appear: you owe the full amount.
The deposit is not a penalty. We offset it against what you owe under this scale and refund any remaining amount to you. If our actual costs are lower than the percentage in the scale, we will charge no more than those actual costs. If we are able to sell the date to someone else after all, we will set that off against what you owe.
9.3 Gift vouchers
- A gift voucher is valid for five years from the date of purchase.
- Right of withdrawal. The exception in 9.1 applies to bookings on an agreed date, and therefore not to a gift voucher. If you buy a voucher online you have fourteen days to withdraw from the purchase, counted from the date of purchase. Within that period you can cancel without giving a reason and we refund the full amount, provided the voucher has not yet been redeemed. An email to info@culinary-crew.nl is enough.
- The voucher is transferable and not personalised, unless you ask for that at the time of purchase.
- If the voucher is worth more than the booking, the remainder stays available for a future occasion. If it is worth less, you pay the difference.
- The voucher is not paid out in cash, unless a small remaining balance is left that cannot reasonably be spent.
- If we cease trading, you can redeem or reclaim a still-valid voucher within its remaining validity period.
9.4 What you may expect from us
We deliver what was agreed, on the agreed date, at the quality you may expect based on our description and the price. If we do not, you have the statutory remedies that apply to defective performance: repair, an appropriate price reduction, or termination of the agreement.
9.5 Making a complaint
If you are unhappy about anything, please tell us at info@culinary-crew.nl or +31 6 27 21 18 16. Preferably within fourteen days of the event, so that we can still establish what happened.
We will respond substantively within five working days, or let you know within that period when you can expect an answer. If we cannot resolve it together, you are free to bring the dispute before the courts. As a consumer you may choose the court of your own place of residence; the choice of our place of business in article 8 does not apply to you.
